Yet Another Rosales Firing Controversy
Classic la toxica trait.
The context was the dismissal of more than a hundred cases. But today's news can't go undiscussed.
But trust me, I'll circle back to it because its an important conversation.
For now lets talk about the fact that District Attorney Yvonne Rosales fired John Briggs, a senior trial lawyer and the only one in her office with any death penalty experience.
Wrap your head around that for a minute.
The family law lawyer that had never tried a felony before becoming the County's Chief Prosecutor fired the only attorney left in her office with experience trying death penalty cases while we an alleged mass murder sitting in county jail awaiting trial.
So is this a sign that she's no longer going to pursue the death penalty? Her staffing moves have left so many people in the legal community completely stunned. Remember she went out and recruited out-of-town lawyers to try the case - I guess she doesn't trust the talent in her own office and in our own community to try the case?
I don't know, none of it makes any sense.
Lets have some real talk about this. Rosales tried to get a trial date before the feds have theirs for apparently no other reason than to politically capitalize off the press coverage of the trial - but was checked by the judge saying that she hadn't event filed one document on the case with the court before trying to do so.
There has basically been one person that has done the most work on the case - the most important legal case this community will EVER see - and she fired the vato.
Sources in the DA's office say the way it was done is pretty gaucho. He (John Briggs) apparently had no notice. It just went down earlier today and he had to pack up all his stuff and go. I'll bet she didn't even personally do it. She probably sent Cox to do it.
I think I speak for most El Pasoans when I say I hope he goes into private practice as a defense attorney and spends the rest of his career kicking the DA's office in the ass on every case he takes.
Also, where does this put the Deputy Herrera case? There's no one in that office with death penalty experience, and he was fired so who's going to try that case?
Taking a prosecutor off a case is inevitably going to slow down the process. Anyone remember the adage of justice delayed is justice denied?
All of the non-stop controversies from the District Attorney's Office would be comical if it didn't have such sincere and dire consequences. That office is a shit show right now and has never been more dysfunctional.
This is absolutely no measure by which someone can say with a straight face that Yvonne Rosales as a District Attorney has been an improvement to Esparza.
Its almost like someone wrote a script on how to lose re-election and she's upping the ante.
